Intellectual Property and Technology Forum DIGITAL COPYRIGHT ...

The advent of the digital age and the wide diffusion of copyrighted works over the Internet have brought about a drastic challenge to the pre-existing rules and legal standards governing the exchange of information. This article points out one of the ways the development of these new technologies has altered the boundaries of copyright, specifically by enabling copyright holders to strategically expand the scope of protection through the strategic use of Digital Rights Management (hereinafter, DRM). After a brief overview of these technologies and their contribution to the development of online markets for copyrighted works, the article discusses the risks of using DRM as a means of stretching the legal protection conferred by Intellectual Property law.

As a potential solution to such problem, the article looks at the role of the courts and the approach embraced vis a vis specific cases of abuse of DRM in the copyright context. In carrying out this analysis, some considerations are made on the pro-competitive benefit that may derive from these practices, and thus the different outcome that would result from an application of a pure antitrust scrutiny to the same situation. The article then concludes recommending a two-fold approach to the assessment of the legality of such practices, where antitrust analysis and IP principles are intermingled, proposing a legal test to facilitate this complex assessment.

Lawyer: Bahrain overturns activist's Twitter case

MANAMA, Bahrain (AP) ? A Bahrain judge on Thursday overturned a conviction against a prominent human rights campaigner for posting alleged anti-government comments on social media, but the activist remained jailed while appealing another prison sentence.

The decision shifts the focus among Nabeel Rajab's supporters to next month's challenge of a three-year sentence for his role in allegedly encouraging protesters to clash with security forces in the strategic Gulf kingdom, which is home to the U.S. Navy's 5th Fleet.

Bahrain has faced more than 18 months of unrest between the Sunni-led monarchy and majority Shiites who claim they face systematic discrimination. More than 50 people have died and thousands have been injured in the violence, which has included escalating attacks on police.

Two policemen were injured Wednesday in a bomb blast in a mainly Shiite area, officials said.

Rajab's attorney, Mohammed al-Jishi, said the judge threw out the conviction for the Twitter posts after a brief hearing. Rajab has already served more than half of his three-month sentence.

A statement from Bahrain's government attributed the judge's ruling to "uncertainty regarding the evidence submitted to support the lawsuit."

"It's hard to celebrate when the Bahrain authorities admit their mistake in jailing Nabeel Rajab for the tweet but keep him in prison until 2015 on other spurious charges," said Brian Dooley, director of the Human Rights Defenders Program of the U.S.-based advocacy group Human Rights First.

"They've found another way to silence him, and that's what matters," Dooley said.

Rajab's wife Sumaiya vowed to press on with an international campaign for her husband's release before the Sept. 10 appeal hearing on the three-year sentence. The court's ruling last week in that case brought rare criticism from Bahrain's allies in Washington and touched off fresh clashes around the kingdom.

Souhayr Belhassen, president of the Paris-based International Federation for Human Rights, called Rajab's acquittal a "relief" but noted that he still could face years in prison.

"At the moment, Nabeel remains in jail and Bahraini authorities continue to smother all criticism," he said.

Bahrain's rulers have offered some concessions, but not enough to satisfy main opposition groups that seek to break the monarchy's tight hold on government affairs and appointments. A government statement Thursday said King Hamad bin Isa Al Khalifa approved changes that include giving parliament greater powers over approving Cabinet posts and policies.

Automotive Industry Sets the Pace with Proactive Security

One of my biggest complaints with security is that it so often reactive, especially on the business level. The security protections are minimal at best at a lot of places ? until something happens. Then security gets a more serious look.

So it was good to hear a story about some proactive security measures, and in an area you don?t automatically think about IT security ? your vehicle.

It?s easy to forget that today?s cars and trucks are run as much by a computer system as they are by gas. We don?t think about our car?s computer until something goes wrong. And now with built-in GPS, satellite radio, all of the interactive gadgets, our vehicles are one giant, gas-powered computer. Just as I talk about the importance of remembering that our smartphones and tablets are powerful handheld computers that need the same security considerations as a desktop, it makes sense to think that a car also needs to be thought of as a computer and is at risk for attack.

And that?s exactly what?s happening at Intel. According to Reuters, ethical hackers are working with Intel?s McAfee division to search for the bugs that could make a vehicle?s computer system vulnerable to a hack or a virus.

I said this research is proactive, rather than reactive. That?s because, as of this writing, there have been no known violent attacks on a vehicle computer system. However, as the Reuters article pointed out:

?Yet, Ford spokesman Alan Hall said his company had tasked its security engineers with making its Sync in-vehicle communications and entertainment system as resistant as possible to attack.?

Could you imagine how nice it would be if this was the standard security approach?

Of course, the car industry is used to innovating safety features before they become standard. Anything that makes a car safer and easier to drive is a big deal to consumers. That the auto industry would move to the next safety feature ? computer security ? makes sense.

And there are signs that a problem could be looming.? According to CNET:

Studies have already proven that it is technically possible to hack into a car's on-board warning systems and alter its tire pressure, as well as prevent it from using its brakes.

Not that the car industry is perfect here. Reuters pointed out that, according to security experts, car manufacturers have been slow to adopt computer security, and that leaves the vehicle vulnerable to an attack. A hack into a vehicle computer system could impair the car?s ability to operate and could result in a crash. Reuters sprinkled around words like ?lethal? and ?violent? in its article to describe potential virus attacks, words not usually used when you think of malware on your computer (beyond the Blue Screen of Death). But violent and lethal outcomes are exactly what happens if a driver loses the ability to control the vehicle because the computer system failed. In this case, a virus really could be deadly.

Computers have become so ubiquitous in our society that we forget in how many instances we depend on them. Computer security for a vehicle makes perfect sense. Now I wonder, what other everyday items should have improved computer security...
