Small retailers hammered by profit drop | Stuff.co.nz

JAZIAL CROSSLEY

Business was bad for smaller, privately owned retailers last year, with profits plummeting more than 76 per cent on average, according to research from accounting firm Grant Thornton.

Its latest survey of 5000 small-to-medium enterprises found the overall average drop in profit for 2011 was 27.7 per cent but the retail sector suffered more than most.

The revenue of retailers surveyed grew 6.7 per cent last year but rising costs, coupled with dampened consumer confidence, hit the industry hard. Grant Thornton partner Paul Kane said the cost of sales was up 12 per cent on average.

"There has been pressure on profit margins so you could say that means people are price-conscious, looking for bargains. The retail trade has looked at their prices and brought them down accordingly but reduced their margins," Kane said.

Wellington menswear company Mandatory, in its 15th year of trading, has begun to see an improvement in sales this year but owner Clare Bowden said the trading environment was still volatile.

The company had been extremely careful with product ordering and stock levels. It found being a small manufacturer was a considerable advantage.

"We can just produce as we go. We've got a huge custom-made element that has really seen us through. Staffing and stock levels have to be pretty lean. It's tight, but we're certainly seeing an increase and an improvement," Bowden said.

"The rag trade, in particular menswear, has had an extremely tough time,"

Womenswear also struggled. Boutique clothing label Vanilla Ink has just two stores in Auckland, closing a third outlet in January last year.

Owner Susan Duckworth said that since May last year, trading months that were typically strong proved below average.

"You have to just think so much smarter to do the same as you did before."

Duckworth said shoppers at Vanilla Ink's annual February sale were more cautious with their cash.

Early indications showed sales were starting to improve this year with some increased consumer confidence back in the economy.

Retailers Association chief executive John Albertson said anecdotal reports suggested things were improving, but not dramatically.

"I don't think retail will ever go back to where it was six or seven years ago."

Kane agreed 2012 appeared to be proving better for small-to-medium retail businesses.

"Even though margins were down last year, most were still profitable. I think the outlook for this year is pretty good.

"There is going to be growth, certainly, but not dramatic growth. I think we'll see a gradual incline throughout 2012 and 2013."

Bump Pay lets you tap a friend for cash

Image
Taking cues from an ING Direct app that used its API, Bump Technologies has developed its own version of the mobile payments software, enabling phone-to-phone "Bump" transactions using PayPal. Yes, PayPal. That minor processing detail aside, the service appears to offer a fun solution for simplifying the fairly painful process of paying the check at group meals, or splitting a tank of gas with a friend. Both you and your bud need to have the app installed before you can beam that green, and there's no option to send payments remotely, though you could always use plain ole vanilla PayPal for that. The app is free, and if you have a checking account linked you won't have to deal with any fees. Bump Pay is iOS only "at launch" (read: it could be making its way to Android as well), so for now you'll need to bump the App Store to get folks paid.

kent - Seeking a legal advice in Structured Settlement selling

While the Net provides an invaluable option to assist in researching topics normally reserved for experts, it is not intended to serve as a substitute for seeking professional advice whether legal, medical, or financial. Depending on the author and purpose of the post, there could be several conflicting opinions on the same issue. The objective for this article is to provide the necessary information to assist an individual considering the sell or transfer of a structured settlement. Because each structured settlement is particular and unique, it is the responsibility of the seller to seek legal advice before forfeiting rights to future payments. Unfortunately, there have been many examples of recipients of structured settlements being taken advantage of by companies preying on their financial hardships. In an effort to prevent this from happening, most countries have adopted a Structured Settlement Protection Act (we talked about it in my previous article, few time ago)?that allows the sale of future payments if certain requirements are met. Seeking legal advice from an estimable attorney with experience in structured settlement laws will ensure that the seller has all the facts before making the decision to sell.?Most countries followed a model when using the Structured Settlement Protection Act requiring certain conditions be met before the sell or transfer of structured settlement payments. Following are the common requirements that must be met from country to country:

  • the seller must be given full disclosure about the financial terms of the selling;
  • there must be a ?cooling off? period after the documents are signed to allow time for the seller to change their mind and erase the selling;
  • the seller must be advised in writing to search independent professional advice regarding the selling;
  • there must be a court hearing to review and approve the selling. The judge analyzes the seller?s financial situation and the intent for selling the settlement payments and rules whether it is in the seller?s best interests to sell payments;
  • the judge must issue a court order approving the selling.

While most countries adopted this general model, every state?s statute could have further restrictions or requirements that must be met. An attorney will review the settlement details, also if there is anti-assignment or anti-sale language with respect to all applicable federal and country laws and provide their professional opinion on whether the selling of structured settlement payments is in the best interest of the seller.

(AP) ? Searchers found the body of a 4-year-old boy Wednesday in the river at an Arkansas Boy Scout camp where he was tagging along with his aunt last weekend.

A search team in a canoe spotted Caleb Linn's body in a tributary of the Spring River, according to the Fulton County Sheriff's office.

Caleb went missing Saturday at the 900-acre Kia Kima Scout Reservation near Hardy, Ark. Searchers in boats and on horseback, foot and four-wheelers scoured the valley for days before finding two shirts he had been wearing in the river on Tuesday afternoon. His body was found less than 24 hours later.

"As long as we have each other, it's OK," said Caleb's uncle, Chris Bruner.

Authorities narrowed their focus to the water late Tuesday and called off the ground search for Caleb. He had gone with his aunt and several other children to help clear storm debris from a bridge at the camp that his aunt was looking after while the regular caretaker was away.

When five of the children left to go back to the cabins around lunchtime, Caleb asked if he could follow. His aunt told him he could, but that he had to stick to the road, Fulton County Sheriff Buck Foley said. The last she saw of him before she turned around to resume her work, he said, was Caleb standing at the end of the bridge.

Hundreds of volunteers turned out to help in the search, and divers cleared debris and stuck an underwater camera beneath the bridge and under ledges where they couldn't get a clear view. Dry and unseasonably warm weather had lent hope to Caleb's chances of survival. Even after searchers found the shirts he was wearing the day he disappeared, Caleb's great-grandmother held out hope someone would find him alive.

"Just because they found the clothes doesn't mean we give up hope," Carolyn Truex said Tuesday evening.

Arkansas State Police spokesman Bill Sadler said searchers found Caleb's body in the river about a half-mile from the bridge where the boy was last seen. His body was to be sent to the state crime lab.

Family members, including Bruner, had fought their way along sandy trails and through thorny branches that would snap back with a thwack as they searched for Caleb on Tuesday. Another uncle, Joey Dawson, even swam to a small island in the middle of the river, just in case Caleb had gotten stranded there.

Caleb's mom and stepdad had travelled from their home in Springdale, 150 miles west of Hardy, and have been staying at one of the cabins while searchers looked for the boy.

Shortly after searchers found Caleb's body, his family started to grieve near the bridge where he was last seen. Bruner says they'll likely bring his body back to northwest Arkansas for a funeral there. In the meantime, a memorial fund has been set up to help Caleb's family pay for his funeral.

"We have a little bit of money, but it's nothing like what he deserves," Bruner said. "We'll do what we can with what we have."

Harvard emails show Zuckerberg's business side

NEW YORK (AP) ? Emails from Mark Zuckerberg's Harvard days show the dropout-turned-Facebook CEO as a young entrepreneur losing patience with a client's delayed payments.

"I contracted out my services for money, and even though I seem to continually be providing services, I don't seem to be receiving money from you guys," he wrote on Sunday, January 25, 2004, according to court documents filed on Monday by Facebook's lawyers. The deal, writes Zuckerberg, was for $18,000, plus a side project for $1,500. He was still owed $10,000. Zuckerberg founded Facebook the following month.

The client, Paul Ceglia, sued Zuckerberg in 2010, claiming that a contract he signed in 2003 entitled him to a 50 percent ownership stake in Facebook. If Facebook's upcoming initial public offering goes as expected, that could amount to as much as $50 billion. Facebook's lawyers are seeking to dismiss the suit. They say the contract is a fake.

Facebook included email exchanges between Ceglia, his associates and Zuckerberg in court documents filed in a U.S. District Court in Buffalo, New York on Monday. Facebook said the roughly 300 emails it obtained from Harvard's servers relating to the case make no mention of Facebook.

Instead, the emails center on a database company called StreetFax that never took off. The two traded messages on technical specifications of the website that Ceglia had hired Zuckerberg to work on, and payments. The emails show a range of exchanges between Zuckerberg and Ceglia, which were sometimes terse and at other times lengthy and detailed.

"I will do my best to try to raise the cash needed to pay the amount requested though I honestly cannot guarantee it," wrote Ceglia on Feb. 22, 2004 according to the filing.

A day earlier, Zuckerberg wrote that he did not think Ceglia would pay him "at any point in the near future."

In addition to losing patience with his late payments, Zuckerberg tells Ceglia's colleague in one email that StreetFax is not a very high priority for him, given that there are "many other things I'd like to, and have started to, work on."

"I am at a school surrounded by some of the smartest people in the world, cultivating ideas and constantly coming up with projects to work on," he wrote in January 2004, just days before launching "Thefacebook," as it was then called. "The last thing I need right now is someone calling me twice a day asking if I've uploaded some small changes to a site that I made eight months ago ... My time is valuable, and seems better spent on things that I know, or at least can reasonably expect, will produce some sort of gratification in the near future."

The last email, from May 2004, shows the two men may have worked out a payment plan, where Ceglia would send $500 a month until his bill was paid in full. It's not clear if the payments were actually made.

Ceglia's lawyers said that Ceglia deserves his day in court where a jury will decide the ownership dispute.

Trayvon Martin hoodie and Skittles rallies spread across nation

From Atlanta to Seattle, rallies were held this weekend calling for justice in the Trayvon Martin case. More Trayvon Martin rallies are planned for today.

In Phoenix, Atlanta, Oklahoma City, Seattle, and Nashville, hundreds of people turned out for rallies and marches this weekend. Many were dressed in hoodies, the same garb worn by 17-year-old Trayvon Martin when he was shot by a Florida neighborhood watch leader George Zimmerman on Feb. 26.

More rallies, prayer vigils, and hoodie protests are planned this week.

About 500 people turned out for a rally and march Sunday afternoon in downtown Phoenix to honor the? unarmed black Florida teenager that police say was fatally shot by the neighborhood-watch volunteer.

"This is not about Black or White or red, green or yellow. This is about a young man on his way back to meet with his family. ... That young man paid a dear price with his life," the Rev. Oscar Tillman told the crowd, according to The Arizona Republic.

In Birmingham, Alabama, more than 400 people attended a ceremony held in a downtown park Sunday night for Trayvon Martin. They gathered at a statue of the Rev. Martin Luther King Jr. Mayor William Bell was among those attending the vigil in Birmingham. He says justice hasn't been done in the case.

A similar vigil was held at the civil rights memorial in Montgomery, Ala., where many demonstrators wore hoodies and carried iced teas. That's what authorities say Martin was doing when he was fatally wounded while visiting family in Sanford, Fla.

In Oklahoma City, dozens of Oklahomans wearing hooded sweatshirts and holding bags of Skittles joined a chorus of protests against the killing of an unarmed black teenager in Florida.

Demonstrators held signs, chanted slogans like, "No justice, no peace" and called for action Sunday in the death of Trayvon Martin.

Police say Sanford, Fla., neighborhood watch volunteer George Zimmerman shot the 17-year-old Feb. 26 as he was returning from a convenience store with a bag of Skittles and some tea.

Officers say Zimmerman told them he shot the teen in self-defense and no arrests have been made. Federal investigators are trying to determine if Zimmerman shot Trayvon because he was black.

Protest organizer Ashley McMillan says she has a son who is biracial and can't imagine him being killed because he is black.

Don't Hire Help, Do It Yourself With These Easy Home Improvement ...

If you are working in the kitchen, around fireplaces or anything else that has a gas line, make sure that you locate the gas shutoff before you begin your home improvement project. You should also be extremely cautious when working in close proximity to a gas line. There are dangers involved when working with gas, and you don?t want to cause a fire or injury.

Pick up a flashy new mailbox to improve the outside of your home. By putting in a newer mailbox, your house will have better curb appeal. Many cities have codes that dictate how far off the road and how high a mailbox should be; therefore, check your city?s codes before installing your mailbox. You can do this job fairly quickly.

Start preparing for your planned remodeling project, even if it?s still a ways in the future, by collecting ideas as you come across them. The sooner you start looking for ideas for your home, the more of them you will come across before it is time to make a decision. Don?t rush into picking color schemes; you don?t want to stress yourself out.

Make sure any contractor you deal with is licensed by your state. This can be cone on your state?s government website or over the phone. Contractors who are unlicensed may have lose their license in some way or may not be reputable.

Tape off surfaces and trim to protect them during dirty work. When you start painting, no matter how hard you try to keep it neat, there will inevitably be splatters that will land on other surfaces around the area that you?re painting. Also, when you?re doing any demolition, there will pieces flying around that can scratch and damage the surrounding surfaces. So, keep your walls protected from flying debris if you are not planning to repaint them. You should also cover fixtures and floors so they are not splattered with paint.

Unsightly air conditioning units may not be attractive, but in other regions it could be a necessity. Wooden trellis and latticework are great for effective camouflaging. You could also try some tall, aesthetic grass, such as pampas grass. It?s important, though, to leave at least a foot between the plant?s roots and the unit.

In home improvement, your first priority should be the good reputation and dependability of your contractor. Don?t be lured by a low estimate from a contractor whose reputation is less than stellar. It is only a good deal if the work is done well and on time. The disreputable contractor may offer a low price, but achieve this by using cheap materials and unskilled labor. Once he is finished with the job, you will find pretty quickly that you will be in need of additional repairs. Not only can this be expensive, but it may also be a hazard; inferior work can lead to accidents that may harm you or your family members. Don?t settle for any contractor that you don?t feel you can trust.

With any luck, these tips can help you see what benefits home improvement can provide. If you have the right equipment, you can really personalize your home. Make home improvement your hobby and save money in the process for fun and helpful work.

MIAMI — The Steve Aoki Experience hit Ice Palace in downtown Miami a little after 3:30 a.m. in the early Saturday hours, and the Dim Mak chairman didn't disappoint. He powered through a set loaded with new music and the madness that fans have come to love from his live shows.

In the lead-up to his Ultra Music Festival show slated for Sunday (March 25), Aoki treated the Ice Palace crowd to champagne showers and shots of Grey Goose. He also brought along some very special friends: Datsik, who'll hit the road this summer on Dim Mak Records' Deadmeat Tour; and Alan Strovich, who recently finished a dramatic dubstep remix of "Ladi Dadi." (One of Aoki's biggest tracks, his 2011 "Ladi" features singer Wynter Gordon.)

Many of the tracks Aoki played on Saturday were from Dim Mak's Miami Winter Music Conference sampler, which dropped 10 days ago on Beatport. Those included the banging new gems "Dance" from Spencer & Hill and Dirtyloud; "Turn Up the Volume" with Joachim Garraud and Autoerotique; and Aoki's smash tag-team with Tiësto on "Tornado."

It was a crazy show to say the least. And with his date on the Main Stage at Ultra just hours away, it proved to be an exciting prelude to what we predict will be one of the most impressive stage dives at UMF.

Scientists link chromosome length to heart disease risk

BOSTON, MANo one really wants the short end of the stick, in this case the short end of a chromosome. Telomeres, which are DNA-protein complexes at the ends of chromosomes, can be thought of as protein "caps" that protect chromosomes from deteriorating and fusing with neighboring chromosomes.

It is typical for telomeres to shorten as cells divide and chromosomes replicate over time. Now a new study from Brigham and Women's Hospital (BWH) suggest a strong link between telomere shortening and poor cardiovascular outcomes in patients with acute coronary syndrome.

The study is being presented at the American College of Cardiology 2012 Annual Scientific Session, March 24 to 26 in Chicago.

Scientists measured telomere length in 5,044 patients with an acute coronary syndrome who were followed for 18 months.

They evaluated the risk of cardiovascular death or heart attack based on telomere length and other characteristics.

Shorter telomeres were associated with older age, male gender, smoking, prior heart attack and heart failure; although, the correlation between each individual factor and telomere length was modest. Age, for example, only accounts for seven percent of the variability in telomere length.

Telomere length was strongly associated with risk of cardiovascular death or heart attack. Patients with shorter telomeres had the highest risk. This relationship was consistent across various age groups.

"We know that many different genetic and environmental factors, like diabetes, high cholesterol and smoking predispose patients to suffering cardiovascular events," said Christian T. Ruff, MD, MPH, Cardiovascular Division, BWH Department of Medicine, and lead study investigator. "Even when accounting for all of these other known risk factors, patients with short telomeres have an increased risk of having a heart attack or dying from heart disease."

Taking the research findings from bench to bedside, Ruff points out that measuring telomere length may be useful in a clinical setting, providing a sort of predictor for cardiovascular events.

"Telomere shortening may represent some sort of 'biological clock' which integrates the cumulative effect of environmental and genetic stresses on the body, both of which can contribute to cardiovascular events." said Ruff.

The researchers will continue to validate their findings to see if the relationship between telomere length and cardiovascular outcomes holds true in broader populations of patients. They also plan on experimenting on whether the rate of telomere shortening over time also predicts adverse cardiovascular events.

"In the future, we hope to identify clinical, biochemical and genetic characteristics that predict telomere shortening," said Ruff. "We hope to have the ability to determine if therapies and medications that impact these processes may delay telomere attrition and lessen the risk of cardiovascular events in these patients."

John Dvorak's Second Opinion: Microsoft may be poised to challenge Apple

By John C. Dvorak

BERKELEY, Calif. (MarketWatch) ? Right now, Microsoft Corp. seems poised to do something bold: go into the computer business to compete with Apple Inc.

This is possibly being done under the guise of its new emphasis on the Xbox360 and the upcoming Xbox720 which maybe be previewed later this year.

An article in the superb All About Microsoft blog by Mary Jo Foley titled, ?Is Xbox the new center of the Microsoft universe?? reveals some interesting changes at the company. It led me to this conclusion. Read blog post.

Her post stems from some interesting commentary by an employee who has shuttled back and forth between Microsoft /quotes/zigman/20493/quotes/nls/msft MSFT +0.05% ?and Google. It reveals the fact that Microsoft is quietly targeting the Xbox division as a primary focus. Microsoft may have finally realized that the Xbox can become more than a game console.

Zynga shares fall as insiders plan stock sale

Shares of Zynga Inc. fell on Friday following a regulatory filing showing that insiders at the social-game maker plan to sell more than $558 million worth of stock as part of a secondary offering, Dan Gallagher reports on digits. Photo: Getty Images.

When the Xbox360 was first shown, I recall seeing some demos of its media server capabilities. At the time though, to be fully implemented users had to have a special version of Windows XP called Windows XP Media Center Edition.

The problem was nobody ever heard of Windows XP Media Center Edition, and those who did hear of it never knew what it was for. The company never sent samples of the product to the media, that I know of, and never lectured anyone about its power.

The capabilities of the Media Center idea kept growing nonetheless and many casual users of the Xbox360 essentially are running an IPTV lashup through their TV sets after having installed Netflix on the Xbox360.

In essence, they are streaming TV shows through the Xbox from the Internet to the TV set.

Microsoft has done a very poor job of pushing the capabilities within the Xbox division. Instead it spins its wheels on the Windows Phone and Bing fearing an overall threat from Apple /quotes/zigman/68270/quotes/nls/aapl AAPL -0.55% ?and Google Inc. /quotes/zigman/93888/quotes/nls/goog GOOG -0.54% ?, respectively.

This may be changing if Microsoft can realize it has a market all to itself and a real competitor to Apple if it can make the Xbox720, or whatever it is called, a full blown computer that is also a game console. I?m thinking Xbox-PC.

The reason I suspect this is going on is that in January Microsoft moved operating system guru and genius David Cutler to the Xbox division. I didn?t see the significance of this when it happened. But now I do.

Lost phones cost Americans $30 billion a year

Every 3.5 seconds, someone in America loses a cell phone. And more often than not, it happens in a coffee shop, a new study says. Quentin Fottrell explains how you can hold onto your mobile on digits.

Cutler was the designer behind the hottest Digital Equipment (DEC) operating systems when he was brought to Microsoft to design Windows 2000, considered by many to be Microsoft?s best OS, ever. Everything since then stems from Windows 2000.

At 70, you?d think the guy would retire or become a professor at UW as opposed to going to a division that makes a game console.

The tricky part will be how Microsoft executes a potentially new platform. Right now there is no evidence that they can pull off an original idea, if that?s what is indeed going on.

But if they can, then the industry can get exciting again. And I?ve always been convinced that Microsoft has always wanted to produce a branded desktop computer like Apple does with the Mac. This may be what we are about to see. The Xbox-PC.

PARIS (AP) ? France's prime minister fended off suggestions Friday that anti-terrorism authorities fell down on the job in monitoring a radical Islamist who gunned down children, paratroopers and a rabbi in a wave of killings that revolted the country.

Investigators were questioning Mohamed Merah's brother as they search for possible accomplices in his close-range killings of seven people since March 11.

Merah, who claimed allegiance to al-Qaida and had spent time in prison, died Thursday during a gunfight with police following a 32-hour standoff outside his apartment in the southwestern city of Toulouse. He was a 23-year-old Frenchman of Algerian origin.

French intelligence services had been aware of Merah's trips to Afghanistan and Pakistan's militant stronghold of Waziristan in recent years, and he had been on a U.S. no-fly list since 2010.

Some politicians, French media and Toulouse residents questioned why authorities didn't stop him before March 11, when he committed the first of three deadly shooting attacks.

Even French Foreign Minister Alain Juppe said there needed to be "clarity" on why he wasn't arrested earlier.

The daily Liberation listed seven questions about the case on its front page Friday, including "Why wasn't Merah monitored more?"

French Prime Minister Francois Fillon told RTL radio Friday that authorities "at no moment" suspected Merah would be dangerous despite a long criminal record.

"The fact of belonging to a Salafist (ultraconservative Muslim) organization is not unto itself a crime. We must not mix religious fundamentalism and terrorism, even if naturally we well know the links that unite the two," Fillon said.

Three Jewish schoolchildren, a rabbi and three paratroopers died in France's worst Islamist terrorist violence since a wave of attacks in the 1990s by Algerian extremists. Merah told negotiators he killed them to avenge the deaths of Palestinian children and to protest the French army's involvement in Afghanistan as well as France' law against the Islamic face veil.

In response to the slayings, Fillon said President Nicolas Sarkozy's conservative government is working on new anti-terrorism legislation that would be drafted within two weeks. He said the government will consult with leaders of the Senate, which is controlled by the opposition.

Cathy Fontaine, 43, who runs a beauty salon down the street from the building where Merah was killed, said France should have a "zero tolerance" policy for people who seek out training in Afghanistan and potentially refuse to let them back in the country.

"An individual who goes to be trained in Afghanistan, you have to follow him," she said.

Families of the victims, meanwhile, were frustrated that Merah was not taken alive.

"Imad's parents feel that the justice they were expecting was stolen from them," said lawyer Mehana Mouhou, lawyer for the family of the first paratrooper killed, Imad Ibn-Ziaten. "His mother wanted an answer to the question, 'why did he kill my son?'"

The lawyer also questioned why hours of negotiations between police and Merah failed Wednesday. Merah repeatedly promised to surrender, then eventually changed his mind.

"They could have very well not killed him. There were no hostages. The neighbors were evacuated," Mouhou said.

The chief of France's elite RAID police unit, which conducted the operation, told Le Monde that Merah was probably killed by a sniper. He said the gunman had been waiting "like a fighter, with an unflagging determination."

"We tried to exhaust him all night before retaking the apartment," Amaury de Hauteclocque was quoted as saying by the newspaper. His commandos slipped into the apartment but Merah was waiting for them, standing in 30 centimeters (a foot) of water after a pipe burst when it was pierced by a bullet during the first assault, the report said.

"I'd given the order to only fire back with stun grenades. But as he moved through the apartment he tried to kill my men who were on the balcony. It's probably one of the snipers that got him," he said.

He said 15 men had taken part in the assault, with 60-odd people participating in the entire operation.
